The first time you run into a PS3 game that you cannot play on your PS3, Sony's product doesn't correspond to the description it was sold to you under, and at least under EU law you have a pretty firm footing.

I know some games might get you to update, but those update will not remove "otherOS" for legal reason, its obvious. The update will be needed only to connect to PSN. Its the only service agreement they can use legally speaking to remove "otherOS".
