That ELSPA report is laughed at by every developer on Earth. The R4 chip isn't even sold in the US and the volume of DS gamers (remember the demographic) that are technologically knowledgeable enough to do so is impossible at 90%.

R4's been banned, but you can buy similar cards (not chips) pretty easily.  Moms love them.

And there's no knowhow here, it's basically plug and play (unless you're using a DSi).  If you can use google, you can pirate DS games.  If anything, pirating PSP takes far, far more technical knowhow (and a PSP1000/2000, which are out of circulation new).

But 90%? Think about that for a minute.

Try this. How many people do you know own a DS? Now are 90% of those people pirating games for it? I highly doubt it.

Exclusively?  No.

Have they ever downloaded a DS ROM, for any level of use?  Sure, I'd say the majority have.  I know gamers who "try before buy" all the time, and a lot who end up just skipping the "buy" portion.  I know people who somehow play DS games and don't even own a DS.  I see 8 year olds on the subway with flashcarts.  DS piracy is not uncommon, and anecdotally I haven't seen piracy this widespread since the original PlayStation.

Now, I'd agree that the ELSPA report is likely exaggerated, it's pretty easy to see where their interests lie and how scare tactics would help further them.  But it was just one quick source, from a well established industry group, which was asked for.  DS piracy is practically ubiquitous, and really, the 90% "having ever pirated" figure I don't find that insanely unbelievable with the relative ease of it on DS.

I hope everyone realizes that this is an argument Nintendo can't win. It's certainly not the first iteration of the argument, either - first, Nintendo was going to be doomed. When they seized the lead, the argument changed to that they don't sell software. When they overtook the competition in that, the argument changed to that they don't sell third party software. When NPD said that they overtook even the 360 in North America, the argument changed to that they don't sell more third party software than the competitors combined. And if they sell more total 3rd party software than the PS360 combined, the argument will change yet again, likely to that they don't sell more software than the PSPS360, or that they're not selling _the right_ third party games.

If Nintendo were to meet their definition of selling third party games, the argument would just change again, as it always has. That's because it's easier to arbitrarily redefine success to exclude the Wii than for the industry at large to admit they were wrong about it.

Once they find out they are proven wrong they quickly change their excuse to something else, then when they are proven wrong again they choose another excuse card, what happens if they run out? I think they are just not going to make any comment.

They will never run out, because there will always be another excuse.  Even if Nintendo wins by all objective measures, its detractors will fall back on subjective measures (the Wii isn't a true gamer's system), or on unreasonably high expectations (the Wii doesn't sell more third party software than the PSP, the PC, the PS2, the PS3, the 360, and the N-Gage combined).  And if that doesn't work, they'll just point to the usual 'test' games (eg Zack and Wiki, The Conduit) as justification for their viewpoints.  The goalposts will forever be out of the Wii's power to pass, and the past three years have made that abundantly clear.

It's amazing how arrogant he is being for a company that has the last place console.

Look, people can try and spin this any way they want, but the FACT is that despite Wii having a much lower quality in 3rd party software for the most part, and a much stronger 1st and 2nd party library to compete with, Wii STILL largely outsells PS3 3rd party software

But all this means is that Wii owners must have way lower standards when it comes to quality in games.

Also, the last place console for 3rd party sales, funny enough.

And again: PSP.

Ya know,I use to be a big fan of Sony almost as much as I am with Ninty, but things like this just keep helping me recall why I have not bought a PSP or PS3. IF they would just get over it and do their games and systems they would have had another customer again.

Having not read the thread at all, yet, I have one thing to say: BWAHAHAHA!!!

Seriously, the Wii not selling 3rd party games myth has been shot down several times, and the DS doesn't sell them either now? *looks at the PSP* Right, because there are SO many games that sell over a million on Sony's little portable thing... What's next, Sony claiming they make more off of PSN than MS does from Live?

It's because they have been first before.
