I think e.g. Nintendo will always have a retail presence for their games. If the e-Shop is the only way to get games, then legislators are more keen to force a platform holder to open it up to competing digital stores. Retail is an alternative. If that means physical, key cards or vouchers remain to be seen though.

Would not bother Nintendo, sales are driven by first party software.
