So the issue here is not that its a thing that will happen. Its just that Nintendo is TRYING to do it?

The issue is that Nintendo is paving the way to do it. If Nintendo wasn't fully intended to do it in the future, they wouldn't have added this in the first place. I can imagine throwing this before the Switch 2 launch is intended to see how people react, as well as check whatever legal hurdles might come out of it. If they throw it when the Switch 2 launches, it will cause a massive clash that could affect sales, but considering how quick the news cycle goes, people might have forgotten all this by the time the console launches.
