If someone steal groceries in a shop you don't go to their houses and take to the trash can other things they have already paid for 

No, but you are probably banned from the shop and cant buy other things you didnt steal from there.

Which is fair. But Nintendo new policy states:

"You acknowledge that if you fail to comply with the foregoing restrictions Nintendo may render the Nintendo Account Services and/or the applicable Nintendo device permanently unusable in whole or in part"
