I feel like in order for something to be racist, it needs to have ill intentions. But not everybody feels that way. So again, who decides what is considered racist?

A judge, based on what's written in a law/constitution about the topic, as anything else. If you do not agree with the decision, you can try another decision twice more with different judges.

Brazil has always had the reputation for being really good with regards to acceptance of various races and colors.  I'm really surprised that your nation would feel the need to implement a law with such a harsh punishment.  That woman isn't going to be able to see her family.  A kid just lost their mother for almost a decade for some smack their mom talked.
