But if just saying racist stuff is criminal, then jails would be full of mentally ill homeless people arrested for screaming racist remarks while under the influence of whatever. A judge, based on what's written in a law/constitution about the topic, as anything else. If you do not agree with the decision, you can try another decision twice more with different judges.
