If you hurt someone physically or mentally torment them with racist remarks, then of course you should go to jail. But if just saying racist stuff is criminal, then jails would be full of mentally ill homeless people arrested for screaming racist remarks while under the influence of whatever. Also who decides what is and what isnt racist? The judge, a jury, the police, politicians or maybe a mix of all four? If progressives get a hold of that law, then comedians like Russel Peters would get life in prison. I feel like in order for something to be racist, it needs to have ill intentions. But not everybody feels that way. So again, who decides what is considered racist? |
A judge, based on what's written in a law/constitution about the topic, as anything else. If you do not agree with the decision, you can try another decision twice more with different judges.
