Which is why we institute laws such as this to distinguish what information you can and cannot use when making certain decisions. Race is considered a "protected class" and as such, you cannot decide against hiring someone due to race. On the other hand "intelligence" is not considered a protected class, so you are allowed to decide against hiring someone due to college grades.
Your other complaints such as "female waxers" are considered within the law under the "Bona Fide Occupational Qualification" provisions of anti-discrimination laws, which essentially state that if a certain quality is fundamental to a position, the employer may discriminate based upon that quality.
