Meanwhile, not every other major publisher has been as aggressive as Nintendo and their zero-tolerance approach. For example, Microsoft has allowed fan games based on their IPs to exist, including SPV3 and Installation 01, and they even have a set of rules outlining what is and isn't allowed with such fan projects (ElDewrito was an example of something that violated those rules, as it was an attempt to release a modified version of a game that was never intended for release to the general public). |
Zero tolerance is pushing it too far: If it's gonna be free and in a creative way (so not just copying the game), they're often okay with it. Just look at Abobo's Big Adventure or Super Mario Crossover for instance. Or all those Kaizo Marios
