1. Goku is NOT a video game character.
2. If he was included, what would be next ? Eric Cartman ? Naruto ? Mickey Mouse ? I'm serious, if you start breaking the rules for 1 character, you'll need to start doing it for others.
3. Most Important point: Video Game characters should at the very least have priority over everything else.
I'm not completely against Goku in Smash, but actual video game characters should have priority over him. In this order
Nintendo Characters >>>>> 3rd party characters >>>>>>>>>> Whatever else you want.
Edit : Also, the ROB argument is stupid. Sure, ROB started off as a "toy" but it was created by Nintendo as an "accessory" for the Famicom so it's a nintendo character, and arguably, a video game "character". The fact is, he was created by Nintendo so he's a nintendo character.
