Smash Bros was originally meant to include exclusively Nintendo characters then it expanded to third party characters who at least appeared once on a Nintendo console now we got a third party character who has never appeared on any Nintendo console whatsoever.
So let's forget about the gaming first argument.

Bandai Namco owns the videogame and toy rights to DBZ and they co-developed Smash 4 so this would be not a problem at all if they really wanted to.
