I hacked 3DS is nothing to worry about. It's even a good thing. There's tons of good homebrew out there plus you don't have region lock anymore. I'm not even talking about piracy, screw that, you don't need piracy, but keep the hacked 3DS. You can upgrade the firmware just fine, you don't have to worry about going online, Nintendo can't tell if you're on a modded system or not. Plus a softmod is perfectly legal anyway.
