Point is that need to work same in both modes, most likly it want work with touch screen in on mode and without screen in different mode. It has lost sales being on Wii U only and thats why they ported to 3DS. 3DS version is easy money grabber and game actually suits perfectly for 3DS and dual screen.

While docked it can use both the direct imput from the controllers or the motion controll through the minicontrollers, while undocked it can use te more precise and fast touchscreen. It won't be able to work the same way, but I'm sure it will work enough that Nintendo will approve the project anyway.
