In comparison, imagine announcing a game at E3, showing a trailer that gives the impression of gameplay footage, and then coming out after the E3 announcement and stating "you shouldn't assume what you saw on the E3 trailer represents actual gameplay footage".
Ohh wait, that kinda did happen with titles like Alien: Colonial Marines. Lawsuits were filed over that. I think that's how the phrase "bullshots" game to be. It was a big deal. Why should Nintendo get a free pass if that turns out to be the case here?

Its written at the end of the trailer that "game images are not final and may not represent that game" or something of the like.No9body is being misleading here.

I'm sure similar disclaimers worked out well for Alien: Colonial Marines.
