All major third parties should be briefed on the system and have functioning kits by now. 

Even naughty dog didn't know the final specs of PS4 before in May before launch.  They thought it was getting 4 gigs of RAM. They use PC's to design games, and the dev kits just aproximate the architecture.  It wouldn't be surprising at all for Nintendo to be holding back the final GPU, RAM or other qualities.

Sony did change the RAM in the PS4 late, but the general performance envelope was pretty much the same and they were able to obviously work on games. 

This sounds like either Bethesda has no idea what the performance envelope for the NX is, which is pretty insane for a system 8 months away from launching, or they know full well and this is a nice way of saying "no thanks" while leaving the door open.
