I don't think they're making a phone, but it wouldn't surprise me if NX ships with a controller that basically can run Android on its own.
A mobile chip akin to something that's in the Galaxy S5 or iPhone 5 would be dirt, dirt cheap today and run tons of apps, if they're going to have a screen on the controller anyway (like that free-form patent), they could easily put one of those into the controller, and now suddenly you have a functioning Android tablet basically. Nintendo could still have their own custom OS though, it would just be a customized propietary version of Android.
Then you could have it ship with a cheap console and probably still have room left over for another type of gimmick (second controller).
