From the leaks/rumors we have now, all games made for PS4 have to be compatible with Neo and vice versa, its likely that Microsoft will have a similar policy. If that is the case than power is no excuse for 3rd parties to exclude NX if it is somewhere around XBO/PS4 level of power.

I think it's more likely they won't even bother, specifically the Western developers. No one wants to make like 6 different versions of every game, and Sony/MS are gaurunteed support first and foremost quite frankly because they do deserve it (they have a proven audience base that will buy Western 3rd party games). 

I just don't see Nintendo being much of a priority at all for developers, Sony/MS are basically shutting Nintendo out of the traditional market by having this much hardware all at once. 

The other problem is Nintendo fans hold a bit of a double standard here in that they feel they should get equal quality games to the PS4/XB1 even probably Neo/Scorpio, in other words they won't buy the NX version of a third party game if it runs better on another platform, we saw that with the Wii U with third party titles being shunned because they ran a whopping 5 fps slower or were a few months late or whatever. 

Those initial ports will then likely bomb which will then lead to the developer throwing up their hands and saying "well we tried, but NX doesn't work for us", it's a fairly predictable movie by this point.
