How many games use more than one layer though and with legitimate reason other than not being lazy with compression, PS4 and X1 games have mandatory installs so data is not read off the disc, going by the patents it seems installs could also be an option on NX. Who is also to say larger sizes aren't available if need be.

So? If Sony or MSoft can't convince third parties to compress their games, do you really think Nintendo could do it? And why should they? Because otherwise they couldn't sell their games on NX? They aren't selling them on Wii U/3DS and are doing quite well without them.

But of course, if Nintendo makes a machine designed to sell their own games and not focused on third parties (something that isn't as bad as it could seem, if done right), then ROMs should be fine if they are willing to take the extra costs.
