Aye especially not Nintendo, they felt that the Wii-U suffered a great deal from the popularity of tablet gaming which massively increased between the consoles reveal and launch, they have it in their mind that if they show off the special "gimmick" of their new system that it could be leaked and copied before they manage to bring their system to market.
And yeah... if a smaller dev signs an NDA but they've got "indie" amounts of cash in the bank, there is little that Nintendos Lawyers could sue from them if they breach the agreement.
