Do you seriously believe that being a third party getting to create an Amiibo is as easy paying the licensing fees to Nintendo? This is a collaboration between Nintendo and Yacht Club games, according to Nintendo themselves:

"...When we started collaborating (with Yacht Club Games) we were like, 'What's one thing that Nintendo can do that nobody could ever do?' and the natural fit was amiibo."

And in a situation like that there's definitely responsibility on Nintendos part as well. So this is not just like Yacht Club doing all this on their own and Nintendo just licensing out the Amiibo name. For a game like Godzilla or that The Letter game on Wii U, which are literally made without any Sony/Nintendo involvement you can't seriously try to put responsibility on the platform holders.
