Whether you consider them second party or not, it doesn't mean you are correct. They are part of Nintendo just as ND is part of Sony and any other studio is part of its parent, just like Bioware to EA.

There is a difference between something like 343 and Bungie. Bungie made games on their own before being bought out. 343 was created BY Microsoft. Technically, they were both "first party", but totally different situations.
