Nintendo rarely shuts down fan games, and there are plenty of completed fan games of Nintendo franchises right now that have far less original assets than this has.

I might be mistaken, but I faintly remember Nintendo issuing a cease and desist not too long ago.  If I'm mistaken, then it probably was squeenix.
