They are going to lose so bad. By the time the lawsuit hits, more games will start using 4GB, providing more ammunition.

I mean have they never heard of the saying: "If you buy cheap, you buy twice".

How dare the consciences consumer choose the best performance/dollar to meet their future proofing needs based on factual data (legal) provided publicly by the Nvidia. Oh wait, Nvidia didn't give the consumer the data needed to make an informed decision.
