A lot of pirates have two 3DS. One with firmware 4.1-4.5 for single player games and one with updated firmware for multiplayer games (which they buy retail.) The reason is that for a while the flash-cart that they used to pirate these games didn't support online, and when it did (through emulating firmware) each game would have to be included in a patch after say a week or two. Now this cart supports up to firmware 9.1, but most pirates still follow this method. I think Nintendo is more concerned with hackers than piracy to be honest. Cheats were a huge problem in Metroid Prime Hunters and Pokemon in the DS era.
