It's up to Gamestop to decide the details of how they're selling their stuff. I think it's comparable to internet forums setting their own rules that could be interpreted to contradict freedom of speech. For example, on some forums all discussion about drugs is entirely forbidden.
That said, as a consumer I fully support this decision.
