I also doubt a company this old and with so many representants over the time would make a contract with carte blanché for them. They were incompetent if allowed and lenient for not monitoring. In a big company the screw ups of subordinates are all responsibilities of CEO, so you are also responsible for subcontractors. |
We don't know the terms exactly, but promotion, price and games selected for the market are all distributor's choice, and I know it because the social network is hired by them (confirmed), the prices are set by them (also confirmed with stores) and games offered... I know some stores can order some specific titles if they want to (Falabella in my country has the best variety) but in general lines is also the distributor who offers them the games to sell (no amiibos available, no Captain Toad, for example).
I don't know how old is the contract, but Videojuegos Latinoamerica has always been its distributor for the region, since 2002 or something among those lines, they did a decent job during the Gamecube days in my country, we even got an official Nintendo Store in the capital (run by the distributor, not really Nintendo) and during the Wii days we saw a lot of bad choices and they were selling most the bad and casual games of the console. I think NoA gave them a lot of power and let them made a lot of choices (after all they were the experts of the market), but now that the Wii U is struggling Videojuegos Colombia don't know what to do and Nintendo needs to pull the leash if they can, otherwise they could be "leaving" other countries very soon.
