Legs usually depend not only on the game itself but availability of other titles, 3DS Smash could be hurting the game a little, but the lack of any other significant game for the console (till Bayo2) might help it a bit. I only have anecdotical evidence, but in my country (a small one, where few people have the console), the stores only bought the units that were pre-ordered, and I don't think they are planing to bring more, even the grey market is very skeptic about this game, so the legs may come in the holiday period.
