No, I am not "blowing it out of proportion".  MS violated the LAW with this promotion.  They probably got a cease and desist order, because the site only says "see our retailers" now.

If you don't think intellectual property rights are a big deal to game publishers (or perfume makers for that matter), you are kidding yourself.

Actually, no they haven't broken any laws or any contracts. The exclusive marketing contract was between Sony and Activision. Microsoft never agreed to NOT have Destiny adverts, it was just agreed that Activision wouldn't allow them to advertise the game for Xbox. Which with this marketing tactic they technically didn't, no more than any retailer that has the Xbox version of the game on their website does anyway. Ya know, since that's what it linked to and all. Why would perfume makers care? Sure there is one perfume called Destiny already, but IF (that's a very big if) they had copyrighted the Destiny name then Activision would be in trouble for using it as well.

That may be the case... (bolded).. but as they *DO* sign such contracts themselves and they Value those types of agreements, then surely they should be mature enough to follow the rules of them right...

It's embarressing to do such a thing as a company.... nothing wrong with having a joke, but not at the expense of your partners..lol.
