I highly doubt it would. But in a theoritical situation in which one had to choose between a subscription service and cross-buy, we're saying we'd take cross-buy.

I'd take a subscription service across devices :) which would be the same as cross buy and you'd have access to all the games on VC as long as you kept your subscription.

Bolded: that's why it's not the same. Also makes me wonder how the DRM on 3DS would work since it's a portable device that likely would not always have network access.
