Since the Eshop now is linked to your Nintendo Network account, it doesn´t seem a big deal for them to recover your data.
If you have a broken 3ds you just have to take it to your local technical assistence and they can retrieve the data for you, and transfer for a new system, in case your system can´t be repaired properly.
