It is not a fair comparsion, the thread is about Microsoft and Machinima. Mentioning Sony/Nintend is off topic.

I think its relevant because a) it seemed that Somini implied it was only Microsoft doing such things and b) for the reasons I already said - similar example using a company in the industry that also got caught, giving us an idea of what may happen if this is indeed found to be illegal.
