They are definitely guilty for releasing these games, but they were hardly involved in Duke Nukem Forever and Colonial Marines.
DKF has been in development forever (by 3DRealms) and was basically done when Gearbox took over. Obviously they didn't start from scratch and just released it with a few changes.
Aliens Colonial Marines' singleplayer was primarily outsourced to TimeGate Studios. Gearbox made the MP (which is considered to be the best part of the game).
