if they muddled the ruling, it would just end up back on their lap again.  I'm guessing that when this finally makes it to the supreme court (maybe next year?)  they will actually have to definitively rule on it.  

Not necessary.  They could simply refuse to hear it and let the ruling stay.

Anti same sex marriage bans have continued to fail under scrutiny.  The US Supreme Court historically is a very cautious group. Even with Loving vs Virginia – which through out the remaining mix race bans for marriages, came after most states had done away with such lays. 

Their ruing against Prop 8 and DOMA was much more daring as many states still had/have anti marriage bans.  It was a HUGE win for the states.

It will probably be at least a few years before they rule on Utah, and by then, it will probably be a issue supported by most all people (execept for the odd bigot.)  Even in hyper conservative Utah, same sex marriage support shot up like 16 points in the past few weeks. 

Plus, with the Federal Government recognizing their marriages, Utah could be held in contempt and more violations.  It could be really, really bad for Utah.

PS The state approved wasting another 2 million dollars to try to attack the marriages.
