I...hadn't heard about this. Wow. Just...wow. The problem with the eShop at this moment is probably just from the Christmas rush (Sony and Steam both went down too), but this restriction literally makes no sense to me.

It blows my mind that Nintendo (and Sony/Steam) weren't prepared for what was an obvious rush of folks hitting their servers. Nintendo even tweeted folks who were gifting the system to download the updates before wrapping them up: this wasn't a surprise even to them...
