You are 100% correct.
DOMA the 'Defense (Discrimination) Of Marriage Act' as Clinton said who signed it, is probably unconstitutional. As this judges ruled in Utah and Ohio this week, and has several other Federal judges have ruled - including the US Supreme Court as it violates the Full Faith and credit clause of the US Constitution . And one state - can not make a law that violates the US Constitution.
The US Supreme Court did rule DOMA unconstitutional, but only on part of it that was tried in a case this summer. The case and ruling did not effect other parts, which is the one state doesn't have to recognize another's state marriage under certain criteria.
The Utah judge even quoted the most conservative Supreme Court Judge Scalia in his ruling of Utah's gay marriage ban as unconstitutional.
But with New Mexico, Utah and Ohio's rulings this week. It's days seem to be coming to an end.
