Considering Mutant Mudds is a 3DS eShop title I'm pretty sure Nintendo has seen it. With that said it's still not a rip-off since it's such a commonly used tactic in platformers.

I know, i was just referring to the Ratchet and Clank/Super Mario Galaxy thing
