Firstly, this thing is clearly designed to be a rugged handheld for little kids, hinge removed as a major point weakness for a system that might get left on the floor, kicked etc.
If the controls had been placed lower, the touch screen may have been reachable, but the shoulder buttons would not.
Furthermore if you think little kids with little hands can easily reach the touch screen on the current 3DS while keeping their hands on the controls, then you haven't watched too many young kids on the 3DS. In my experience, when they use the touch screen, they take their right hand off so they can reach the whole screen.
Bottom line, this system it's not designed for people on game forums.
