If they didn't violate nintendo's patents (they very well could have), nintendo can't and shouldn't be able stop that device from being made. I'm not sure how the laws work though if they're marketing for hacking Nintendo 3DS.

I wasn´t talking about it from the legal/illegal angle, what I meant was  that there really is no justification for this card because it will only be able to play (ilegally) downloaded Roms in the near future....and let´s be honest, how big is the percentage of people that used the Flashcards to fiddle around with homebrew and didn´t just dump a gigabyte of DS and SNES ROMs on the card....2%....5% ?

Yes I agree there is little justification, and I agree with your assumptions. And I'm fine with people getting prosecuted for pirating.

I don't agree with  blocking these types of things provided it doesn't violate any patents, because the device itself would not be illegal. Just the people doing illegal things. IE banning filesharing would cause all kinds of problems even though it also is used heavily for sharing illegal copyrighted files. I don't believe that things should be outlawed because you "can" do illegal things with it, regardless of ratio of people doing these things.
