They most likely wrote their renderer based on OpenGL 3.3 and looked at 4.0 to add modified features since it's well, open to look at. It would be nice if they can provide more information on the tessellator though, that's really the main difference in standards other than a few enhancements with DX11 compared to DX10.1 level hardware.

Indeed.  Which is the "We only develop for DX11" line is a very pitiful excuse.

Though I too wish someone, Nintendo or otherwise, would open up a bit more about the API specifics and such.
