Could Nintendo do anything wrong with the 3DS that would allow the Vita to over take it in a few years?

No. I doubt a few years would be enough even if Nintendo stopped manufacturing the 3DS right now. They'd have to stop manufacturing the 3DS and start doing things to benefit the Vita, like advertise it.
