This. They'll definitely be able to get away with it, as it's not really considered content.
That policy is ridiculous, especially considering how much money Microsoft spends trying to pull the same crap on other platforms. It's not something they're likely to enforce, they won't refuse 3rd party support over something as silly as that, especially if the game is a system seller.
