It could work like this ....
You must have a 3DS (hardware) + a copy of the game, the Wii U "connects" to the 3DS unit to verify you have the game. This way people cannot skip of having to own a 3DS to play 3DS games.
You go onto the Wii eShop and for $5-$10 purchase a "HD patch" for the game. This way publishers are happy because they're getting a fatter profit margin.
You can now play the game in HD resolution + menus redone on your Wii U (your 3DS must be present to boot up the game however).
3DS games look pretty nice upscaled to HD to be honest, Monster Hunter looks fine and Resident Evil Revelations looks great (granted that's a more substantial remake).
I'd take the option of playing games like Luigi's Mansion 2 and Kid Icarus Uprising on my TV/Wii U gamepad for $10 more.
