I think the point is that, in 2013, it shouldn't be a trial-and-error type of thing.
I understand the point of view that "It's their first attempt at this kind of online ecosystem, and they can't be expected to do everything right first time around!" Which can certainly be a factor.
But I would be a much more convincing argument if it were 2006, rather than now. This is Nintendo's 5th console with online capabilities. It's their 3rd (I think?) which supports downloadable titles. There's been plenty of time to learn what works and what doesn't.
And even if it was their first, Microsoft, Sony, Valve - even EA and Ubisoft have created systems of delivering digital content over the past 7 years. At some point, it should have at least been considered how those systems work - every single one of them is tied to an account rather than a machine.
