It is. A video game console does NOT need to connect to a TV, and ANYTHING can be set on the floor and a handheld can be set on a TV, it can be set ANYWHERE.
There are no "subscetions" here. A video game console needs a way to be displayed, that's why some definitions say "TV" (but it can also be the screen on the handheld device). It also has to be dedicated to video gaming as well, which the 3DS is. I think you're confused with what people THINK the definition is.
