I recently had the worst customer service experience of my life over this very issue (yes, with NIntendo of all companies)--short version: do *not* DL anything to your 3DS you aren't willing to part w/ permanently if your 3DS is lost or stolen. Trust me. Utter and complete nightmare. They will run you around until you basically give up.
(I understand this wasn't always the case, but after a dozen emails, multiple phone calls, and a report to the BBB, it wasn't resolved satisfactorily.)
