It's an update which arrived in March I believe. When you go to download something, you'll receive a message asking if you wish to do a sleep download. Click yes, and it'll download later, either when it's on the home screen, or connected to the Internet, or simply in sleep mode. Then, when you turn it back on to play, the download will stop, and will restart when you finish with it again. You can stack up to 10 downloads, and they download much quicker (2-3X) than normal. Fair enough! 
It would be best if it could run in the background during other processes, but now I'm just asking for the normal solution. Even if the 3DS solution is clumsy, at least it's a step forward. I don't like it, but it's much more than what OP led me to believe.
