You can download in the background on the 3DS. So the WiiU is only logical to follow.

Is this new from a recent update? I haven't played my 3DS in 3 weeks now.

My last experience with downloads was waiting after the MGS demo to DL and it took a while.

It's an update which arrived in March I believe. When you go to download something, you'll receive a message asking if you wish to do a sleep download. Click yes, and it'll download later, either when it's on the home screen, or connected to the Internet, or simply in sleep mode. Then, when you turn it back on to play, the download will stop, and will restart when you finish with it again. You can stack up to 10 downloads, and they download much quicker (2-3X) than normal. 

They won't go back. I think you're reading too much into this. So just wait for E3 or for an ACTUAL announcement
