This is an example of a big company abusing their power over small companies. Nintendo are assholes for denying companies the rights to publish sales for their own games, but there's nothing new there, Nintendo as a company has always been evil at its core (even tho I love their games). They are arrogant, over-confident, and lack respect for competitors, other developers and publishers, not to mention how they frequently piss all over their customers and fans.
But asshole companies will alwasy be asshole companies. The problem is that Nintendo is actually allowed to do this. It is clearly an abuse of power, and this amount of control from the publisher's side should be illegal, in my opinion. But as we know, legislation is always one the side of the big corporations, never favors the small businesses.
Oh, and Nintendo: F*** you.
