I read the gamasutra article this was in. Personally I would be more ticked at Sony who as it sounds like didn't give them reimbursement for offering his title for free. (It's in the comments a person asked how many of the Sony's 140k units were the freebees offered because of the hack. He said a good percentage of the Block game was for free which his company took a huge hit because of that.)
And it's not like Nintendo is hiding the sales information from the developers of the game. Sony and Microsoft don't even give out digital sales.
And it no big surprise that Nintendo who has the strictest publishing standards is strict.
