I have a better idea.
Don't delete any posts automatically (by default). Instead, rule-breaking posts are deleted as needed because to me, it would seem that people usually get banned because of a single post. Then there should be an option to ban the user AND delete all posts but this should be reserved for spammers.
But as it seems the current system is an error, I suppose my idea isn't that important.
